TERMS OF USE

The following are the terms that govern the purchase of products through our website www.trastobooks.com, and you are bound by these as they were stated at the time of purchase. It is obligatory for the user to read and accept them before purchasing any products.

Trastobooks.com reserves the right to modify the General Terms and Conditions at any time and without prior notice. They will always be accessible through the website, so that the user can read or print them at any time. 

Trastobooks.com cannot guarantee that there will be no interruptions or errors in accessing the website, although it will make every effort to avoid them and will use all the means at its disposal.

The user accesses trastobooks.com freely and voluntarily, so the company is not responsible for any consequences, damages, or losses that may result from said access.

The prices and conditions of sale are merely informative and may be modified in line with market fluctuations. By placing an order on our website, you agree to the price offered and the general terms and conditions of sale in force at that particular moment. Once the order has been formalised, the purchase will be understood to be fully completed, with all the legal guarantees that protect the purchasing consumer and, from that moment on, the prices and terms will be contractually binding and cannot be modified without the express agreement of both parties. An exception to this is when an error is discovered with the confirmed order as a result of a mistake made during the purchase process. In this case, the company reserves the right to cancel the previously confirmed order, informing the user and reimbursing the amount received. 

Spanish will be the language used for the formalisation of the contract. The relationship arising from the access and use of our website has an indefinite duration, with any of the parties being able to terminate this relationship at any time they wish.

Trastobooks.com reserves the right to deny and/or suspend the access to the services provided on the website due to a breach of the contractual good faith, non-compliance with the applicable legislation, with these Terms and Conditions of Purchase, and/or in cases of fraud detected by this company and/or any of its suppliers.

All products on sale are subject to availability and our acceptance of your order.
We reserve the right to refuse any order without the obligation to provide any reason for the refusal. No order shall be deemed to be accepted by us until we have confirmed it through an order confirmation.
The order confirmation will contain details of your order, the price, and an estimate of the order's delivery date. It is your responsibility to contact us and notify us of any errors with the order as soon as possible. Failure to do so may result in the order being processed incorrectly, and as the products we offer are customised, cancellation of an order that has already been paid for and processed will not be accepted.



PAYMENT METHODS

Payment of the price of the products purchased and, if applicable, shipping costs, shall be made by credit or debit card, bank transfer, Bizum, or PayPal, or using any other payment methods that are enabled on the website at any time.

We inform you that as an electronic payment system, the Virtual POS service of Banco Sabadell is in place.

You guarantee that all the details you provide us with in order to carry out the delivery of your order are correct, and that the chosen payment method is owned by you and that there are sufficient funds or credit facilities to cover the total cost of the order.

SHIPPING

Cuentos con fotos, S.L. does not undertake to deliver the order within a stipulated period of time. Although an approximate delivery date may be given, this is only a guideline. The delivery date does not establish any contractual obligation with our customers. The time taken to prepare the book and its price depend both on the degree of difficulty of its preparation and on the availability of the third parties responsible for printing and transporting it. The usual delivery time is between six and ten working days from the date of the order or from the actual payment of the purchase price for payments by bank transfer.

DELIVERY OF THE PRODUCT

Delivery will be carried out by an external courier company to the address specified at the time of purchase. The user undertakes to provide the correct delivery details during the purchase process.

RETURNS

Given that the stories we offer are completely personalised and made by the end customer prior to their editing and printing, product returns will not be accepted. Returns will only be accepted if the product is defective or does not match the product purchased. There will be period of 14 days from receipt of the product to carry out returns. In order to proceed with the return, the customer must notify the company of this within the established period by email to info@trastobooks.com with the subject “RETURN”, stating the details of the order, namely the reference number and name. If the order received is damaged or defective, the user shall attach a photo of it. In the event that Cuentos con fotos S.L. finds that the product is indeed defective, it will proceed to replace it with a new one at no cost to the customer, with additional shipping costs being borne by Cuentos con fotos, S.L.

The personalised stories are created with the image uploaded by the user to our website. Therefore, trastobooks.com shall not assume any liability for any difference in colour or resolution between the original image and the final story, caused by the poor quality of the original image file. Complaints due to aesthetic reasons are not grounds for a refund.

In the event that the transport company returns to our facilities any order that could not be delivered, because the recipient of the order was not present at the postal address indicated on the package, or the postal address is incorrectly stated, and they have not been able to be reached by any means, we will notify the user of this incident in order to process the delivery again, with the shipping costs being paid by the customer. In the event that the user does not respond to our attempts to contact them, we keep the package in our facilities for a maximum of two months. After this period, the package will be destroyed.

INTELLECTUAL PROPERTY

All content displayed on the website (including patents, registered and unregistered trademarks and service marks, domain names, registered designs and design rights, copyright, database rights, moral rights, and software rights), and all content and materials on the Site (“Site Content”) are owned by us, and shall remain the property of us or our licensors. The website's content may only be used for personal, non-commercial purposes, and may not be reproduced, modified, copied, altered, distributed, republished, displayed, transmitted, or sold in any form, by any means, in whole or in part. You may not remove any ownership or copyright notices from any content on the site.

Given that the products offered are personalised, the user is responsible for the content of the images sent for the production of these stories, and states that they are the sole owner of all existing rights to the images they send. The user also guarantees that they do not infringe the rights of third parties on the persons depicted in the photos.

LINKS

Cuentos con fotos, S.L. will not be responsible for the content of other linked websites not controlled by the company that the user may find on trastobooks.com. It also reserves the right to remove said content if it deems it appropriate to do so.

APPLICABLE LAW AND COMPETENT JURISDICTION.

These General Terms and Conditions are governed by Spanish legislation, notwithstanding the application of EU regulations and international treaties where appropriate.

Any dispute that may arise shall be resolved by the Courts of the city of Madrid.
